In a previous post, I already described how my ex-husband submitted a false affidavit to avoid child support payments. The public prosecutor showed no interest.

It is no secret that every single mother urgently needs this support. It is also widely known that many fathers behave unacceptably in this regard. In my case, we are talking about my ex-husband’s net monthly salary, which exceeds what a large part of the working population in Germany earns as a gross annual salary.

My then-lawyer did not submit the evidence, which was confirmed by official authorities, into the case files. Only a later review of the files brought these circumstances to light. He probably paid well.

When I tried to sue this lawyer for damages, the deadline was already very tight. Since not all of my children were of legal age, the family court appointed a legal guardian for the proceedings.

Contacting her was impossible. Emails went unanswered, sent documents were not read, calls were not returned, and a personal meeting was out of the question.

Six weeks before the deadline, I informed the court about the inactivity of the legal guardian, as it had become very clear that she had no interest in negotiating a damages claim against a (possibly unknown) colleague. Skillfully, she let us “starve on the vine.” I never received a response from the court. The deadline passed.

Shortly after the deadline, I received a bill for the legal guardian’s “activities” amounting to 1,000 euros. I filed an objection, presented emails, explained the context, and reiterated that this lawyer did nothing for us and, on the contrary, caused significant damage. The court conducted a written procedure. The legal guardian explained in detail that I had refused for months to provide documents, claiming she had called me several times, etc. It is easy to prove that this legal guardian is lying. She is blatantly lying. In court!

The court dismissed the case. I filed an appeal—by fax and by mail. The e-fax did not bear a signature, but the letter did. The higher regional court dismissed the appeal because the fax lacked a signature. A formal legal error. The letter, they said, did not arrive…

Apart from the fact that this drama—so to speak, a minor side issue—is of course due to the ongoing lies of my ex-husband, it clearly shows how grotesque court rulings can be.

Submitting false affidavits is a criminal offense. Knowingly covering up a crime is presumably also a crime. Two lawyers? The public prosecutor’s office? The court?

Have the judges forgotten that they are supposed to be servants of the people?

“In the name of the people”—that’s what it says on all rulings.

Should it rather say “in the name of our own justification”? In doing so, the judiciary deals a death blow to democracy. Why do we do nothing? How can all this happen?
