Chronically overburdened judges, stacks of files, insane and often malicious correspondence from unscrupulous lawyers, and biased statements from experts… we could make it so much easier if there were finally a law making psychological mediation a MUST before court proceedings.
The human psyche is complicated, and the one-sided, narrow-minded, and purely case-number-driven handling of court proceedings is, in my view, entirely wrong, at least for all cases in the private law sector.
Why do we overload the judges? Why do we leave all court decisions to so-called sworn experts who, in the end, create reports for money and reputation (and possible follow-up assignments) that usually determine the outcome of court cases?
“My grandmother always used to say, ‘The good Lord gave us common sense.’ The question is, why is it generally not used in court proceedings?”
Common sense can almost replace any level of education, but no level of education can replace common sense.
